再读《我们所有的专利都属于你们》,“你们”的格局变化了吗?

《All Our Patent Are Belong To You》(我们所有的专利都属于你们),一文由特斯拉CEO埃隆马斯克于2014年6月12日发布。

这七年之间的变,特斯拉的电动汽车model3销售量已经突破100万辆,modelY也正在100万辆的路上,到2030年的全年销售量将突破2000万辆。

这七年之间的不变,特斯拉和埃隆马斯克是下一盘大棋和玩阴谋,就和前段时间全国多地限电引发的大棋局和阴谋论一样。

在上述七年的变和不变之间:

特斯拉在中国的销售价格基本是全球最低的;

特斯拉在美国成为第五大市值上市公司;

根据日经新闻与东京分析师公司Intellectual Property Landscape联合开展的一项专利申请和披露研究,特斯拉从2003年成立到2021年3月份,一共累积580多项专利。

务实来说,特斯拉所称的“所有专利”只是一个三位数,“属于”也是一个限缩解释,“你们”不是所有人,特斯拉和马斯克的格局有点小。

务虚来说,特斯拉和马斯克的格局有多大,可能没人知道,包括马斯克自己,因为马斯克的脑子里没有格局这个词,有的只是按自己的风格行事。

如果“你们”还在探究特斯拉或马斯克的格局到底是什么?那就再次被特斯拉或马斯克甩下了,因为马斯克的格局不是在竞争对手和键盘侠,甚至也不是消费者。

特斯拉的格局是马斯克,马斯克的格局无人知晓。

Yesterday, there was a wall of Tesla patents in the lobby of our Palo Alto headquarters. That is no longer the case. They have been removed, in the spirit of the open source movement, for the advancement of electric vehicle technology.(弄掉专利墙)

Tesla Motors was created to accelerate the advent of sustainable transport. If we clear a path to the creation of compelling electric vehicles, but then lay intellectual property landmines behind us to inhibit others, we are acting in a manner contrary to that goal. Tesla will not initiate patent lawsuits against anyone who, in good faith, wants to use our technology.(坚持初心,不互相挖坑)

When I started out with my first company, Zip2, I thought patents were a good thing and worked hard to obtain them. And maybe they were good long ago, but too often these days they serve merely to stifle progress, entrench the positions of giant corporations and enrich those in the legal profession, rather than the actual inventors. After Zip2, when I realized that receiving a patent really just meant that you bought a lottery ticket to a lawsuit, I avoided them whenever possible.(曾经美好,但美好是别人的;提出专利彩票论)

At Tesla, however, we felt compelled to create patents out of concern that the big car companies would copy our technology and then use their massive manufacturing, sales and marketing power to overwhelm Tesla. We couldn’t have been more wrong. The unfortunate reality is the opposite: electric car programs (or programs for any vehicle that doesn’t burn hydrocarbons) at the major manufacturers are small to non-existent, constituting an average of far less than 1% of their total vehicle sales.(修建专利护城河,但强者根本瞧不上你)

At best, the large automakers are producing electric cars with limited range in limited volume. Some produce no zero emission cars at all.(传统强者玩家不和你玩)

Given that annual new vehicle production is approaching 100 million per year and the global fleet is approximately 2 billion cars, it is impossible for Tesla to build electric cars fast enough to address the carbon crisis. By the same token, it means the market is enormous. Our true competition is not the small trickle of non-Tesla electric cars being produced, but rather the enormous flood of gasoline cars pouring out of the world’s factories every day.(不怕电动车汽车公司竞争,忧虑的是燃油汽车一直生产)

We believe that Tesla, other companies making electric cars, and the world would all benefit from a common, rapidly-evolving technology platform. (电动汽车命运共同体)

Technology leadership is not defined by patents, which history has repeatedly shown to be small protection indeed against a determined competitor, but rather by the ability of a company to attract and motivate the world’s most talented engineers. We believe that applying the open source philosophy to our patents will strengthen rather than diminish Tesla’s position in this regard.(是人才定义技术领先,不是专利定义技术领先)
